Welcome to Morehustl Limited’s Terms of Use (“Terms”).

PLEASE READ THESE TERMS CAREFULLY.

1. Introduction

Hustl is a mobile based tool designed primarily for small eCommerce businesses to remove the admin burden by optimising processes and dramatically reducing the time it takes to manage and send out e-commerce orders.

Essentially a personal productivity tool, it makes life easier by providing a single aggregated view of all orders, streamlining the packing and posting process and optimising shipping. It pulls together all elements of the end to end journey from orders to shipping.

Our service (hereinafter referred to as “Hustl” or our/the “Service”) includes access to and use of the Hustl App to:

– Access your orders by connecting sales channels to the Hustl platform
– Access couriers for purchasing shipping labels

2. About these Terms

These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Morehustl Limited (“we”, “us” “our”), and concerning your access to and use of our Service.

You agree that by accessing our Service, you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not access or use Hustl.

Changes

We are constantly working to improve the Services we provide. Therefore, we may make changes to these Terms from time to time to reflect this. We will notify you of any major changes before they take effect and update the date and version of these Terms. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Services after the date such revised Terms are posted.

3. Our Service

Sales channel connection

You can connect to one or more sales channels through the Hustl App to access your orders. The first two connections are free. If you add three or more sales channels, you’ll start paying a monthly fee. This fee will be charged on the 1st of each month and will be adjusted based on when you add or remove channel(s). We calculate the amount you owe each day. If you add and remove a sales channel on the same day and receive orders from that channel, you’ll still be charged for that day.

Shipping labels

We offer the option to purchase shipping labels for your item from a selection of partnered shipping providers. Shipping costs are calculated based on size, weight, shipping service, destination and provider. You will see the total cost before you select the shipping label.

If you buy shipping labels, you will be charged for them the next day. We process payments daily for all labels bought between 3:00 AM and 2:59 AM. For example, if you buy a shipping label at 9:00 AM on March 5th, you’ll be charged for it on March 6th.

It is your responsibility to:
– select the correct size and weight for your item in order to receive valid shipping options
– print and affix the shipping label
– ensure shipping information is correct and complete
– use the shipping label within 30 days
– comply with the chosen shipping providers packaging rules
– comply with the chosen shipping providers prohibited and restricted items rules
– comply with applicable laws and regulations including customs requirements and documentation

If you do not comply with the above, resulting in an issue such as loss, damage or failed delivery, you will not be eligible for compensation and any costs incurred as a result of non-compliance will be your responsibility.

Mistake or cancellation

We understand mistakes can occur. If you need to cancel a shipping label or encounter any issues with a shipping label please contact us at https://hustl.app/support. We will make every effort to resolve the problem and provide appropriate compensation where possible.

International shipping

Our platform may facilitate the creation of shipping labels for international shipments, this is provided based on courier availability for the parcel parameters and destination entered. As such there may be occasions where international shipping is not available to meet the requirements of a specific parcel.

If you choose to ship internationally, it is your responsibility to comply with all international shipping rules and regulations.

As standard Hustl provides Delivery Duty Unpaid (DDU) shipping options. You may also enter your Import One-Stop Shop (IOSS) and Economic Operators Registration and Identification (EORI) number if you have them. This will enable Delivery Duty Paid (DDP) courier options to show should they exist for the given parcel and destination.

Delivery Duty Unpaid (DDU) clarification

Our platform may support the generation of shipping labels for DDU shipments. You must inform recipients that they are responsible for any import duties, taxes, and customs clearance fees upon arrival of the item. These fees are not included in the cost of the shipping label and will be collected by the local customs authority

Import One-Stop Shop (IOSS) information

For shipments to the EU, you may utilise the IOSS system if applicable. It is your responsibility to ensure that VAT is correctly handled in compliance with EU regulations. We do not manage VAT collection or remittance on your behalf. It is your responsibility to include your IOSS number as part of your sender details.

Economic Operators Registration and Identification (EORI) requirement

For shipments to the EU you must ensure they have an Economic Operators Registration and Identification (EORI) number if required. It is your responsibility to include your EORI number as part of your sender details. We do not provide EORI numbers.

Delivery Duty Paid (DDP) clarification

Our platform may support the generation of shipping labels for DDP shipments. You are responsible for any import duties, taxes, and customs clearance fees, and it is your responsibility to follow the appropriate tax and reporting procedures. Hustl is not liable for any additional costs incurred through errors or issues, and any additional costs incurred will be passed on to you.

Returns

Returns do not form part of our service. If your customer needs to return an item, please follow your own returns process.

Tracking

Tracking does not currently form part of our service. However, we will pass courier tracking details through to the connected sales channels. We are not liable if the shipping provider provides inaccurate, incomplete or outdated tracking information.

Liability

As a shipping label provider, our liability is limited to the shipping label. The shipping providers perform the delivery of the Item. We do not physically sort, handle, deliver or otherwise deal with the item sent.

Paying for our Service

You will receive an email outlining the details of charges made.

Your chosen payment method will be authorised and validated when signing up for our Service but will not be charged. We use an authorised payment service provider(“Payment Processor”) to process your payment. Payment can be made via debit or credit and all payments are charged in GBP. No payment or card information is stored by us.

You consent to our charging your payment method on a recurring basis without requiring your prior approval for each charge, until such time as you cancel.

Changes to our Service

We are constantly working to improve our Service, therefore, we may make changes from time to time. We will communicate any changes to you in accordance with applicable law.

4. User guidelines

Licence to use our Service

Subject to your compliance with these Terms and our other Policies, we grant you a limited, non-exclusive, non-transferable, and revocable licence to use our Service – subject to the following:

Age

You must not use our Service unless you are aged 18 or older. If you are under 18 and you access our Service by lying about your age, you must immediately cease use. An age limit has been imposed on our application due to the age restrictions of third-party services we are linked to.

Accurate information

You must provide accurate, complete and current information about yourself and your payment details and update us if this information changes. It is prohibited to use incorrect information or impersonate another person or company through your account.

Stay secure

You are responsible for maintaining the security of your account. Do not share your account details or allow others to use your account. Notify us immediately if you become aware of any breach or unauthorised use of your account.

You must not attempt to gain unauthorised access to our Service or systems.

Legal use

You must not do anything illegal, unethical, contrary to public security, infringes on someone else’s rights(e.g. their privacy or confidential information) or violate any laws or regulations in connection with your use of our Service.

Payment

You must ensure prompt payment of all fees owed to us.

By registering a payment method, you confirm that you have the cardholders prior and full permission.

We will make every effort to resolve non-payment issues with you directly before taking action. However, in the event that you fail to pay, we reserve the right to take the following actions:

– cancel unpaid shipping labels without notice
– suspend or terminate access
– charge late payment fees or apply additional charges as permitted by applicable law
– engage a third-party agency to recover the unpaid amounts
– take legal action

You are responsible for any additional costs incurred as a result of debt recovery or legal action.

If you believe there has been an error in billing or have a dispute regarding charges, please contact https://hustl.app/support within 30 days of the bill to resolve the issue.

Steal or cause harm

You must not(or assist others to):

– scrape, crawl or spider any page of our Service or reverse engineer in an attempt to obtain the source code or our Service without our express permission
– interfere with or try to disrupt our Service, for example by distributing a virus, excessive requests, or other harmful code
– copy, edit, distribute or commercialise any content on Hustl without our express permission
– disparage, tarnish, or otherwise harm, in our opinion, us and/or our Service
– collect, hold or disclose information you obtained illegally that relates to other users or customers, their Content or their actions on the Site, or any information appearing on our Site if it might affect the rights of other users or customers

5. Third parties

Hustl integrates with third-party Services, APIs, or content (“Third-Party Services”). By using our Service, you acknowledge and agree to comply with the Terms and conditions of any Third-Party Services integrated with or utilised through our Service.

You acknowledge that Morehustl Limited is not responsible for the actions, reliability, or content provided by Third-Party Services and that Morehustl Limited will not be liable for damages, losses, or disputes arising from your interactions with Third-Party Services.

You acknowledge that Third-Party Services may contain content protected by copyright, trademark, or other proprietary rights held by third parties. Morehustl Limited makes no claim of ownership over such content and respects the intellectual property rights of third parties.

Morehustl Limited reserves the right to modify, suspend, or discontinue access to Third-Party Services integrated with Hustl, without prior notice or liability to you.

6. Your privacy

Your privacy is important to us. Please read our Privacy Policy at https://hustl.app/privacy for information on how we collect, store, process and keep your data safe.

7. Cancellation and termination

Cancellation by you

You can cancel use of our Service at any time by contacting us at https://hustl.app/support. Cancellation will take effect at the end of the current paid term. You must settle any outstanding payments in full.

Termination by us

We reserve the right to change, suspend, or discontinue any of our Service for you, any or all users, at any time, should we have reason to believe your use of our Service violate our Terms or Policies. We will not be liable to you for the effect that any changes to our Service may have on you, including your income or your ability to generate revenue through our Service. If your account is terminated you must not create another account without our prior permission

These Terms remain in effect after your access to the Service is terminated, or your use of the Service ends.

8. Intellectual property rights

You acknowledge and agree that, all intellectual property rights in and to Hustl, including but not limited to its design, features, functionality, software, code, text, graphics, user interfaces, visual interfaces, trademarks, logos, sounds, music, artwork, and computer code, are owned by Morehustl Limited, and you must not use any of the Hustl IP.

If you use Hustl IP in breach of these Terms, your right to use our Service will terminate immediately and you must, at our option, return or destroy any copies of the Hustl IP you have made.

9. Governing law and disputes

Governing law

These Legal Terms and your use of our Service are governed by and construed in accordance with the laws of the United Kingdom applicable to agreements made and to be entirely performed within the United Kingdom, without regard to its conflict of law principles.

Dispute resolution

If you have any dispute or concern regarding our Service, you agree to first try to resolve the issue informally by contacting us at https://hustl.app/support. We will attempt to resolve the dispute through informal negotiations within thirty (30) days from the date the dispute is first notified to us. If the dispute is not resolved within this period, either party may then initiate formal legal proceedings.

10. Limitation of liability

To the fullest extent permitted by applicable law, Morehustl Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use of our Service, regardless of the theory of liability (contract, tort, or otherwise) and even if Morehustl Limited has been advised of the possibility of such damages. In no event shall Morehustl Limited’s total liability to you for all damages exceed the amount paid by you for accessing or using Hustl during the twelve (12) months preceding the event giving rise to the liability.

11. Indemnification

You agree to indemnify and hold Morehustl Limited harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to your use of our Service, including but not limited to your violation of these Terms, any third-party claims alleging infringement of intellectual property rights, defamation, or violation of privacy rights, or any other harm caused by your actions or omissions. This indemnification obligation will survive termination of these Terms and your use of Hustl.

12. Corrections, modifications & interruptions

There may be information on our Service that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on our Service at any time, without prior notice.

We reserve the right to change, modify, or remove all or part of our Service at any time, for any reason at our sole discretion without notice.

We cannot guarantee our Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to our Service, resulting in interruptions, delays, or errors.

We will not be liable to you or any third party for any loss, damage, or inconvenience caused by your inability to access or use our Service caused by errors, inaccuracies, omissions and any downtime or discontinuance of our Service.

13. Warranty disclaimer

Morehustl Limited provides this Service on an “as is” and “as available” basis. Morehustl Limited makes no representations or warranties of any kind, express or implied, as to the operation of Hustl, or the information, content, materials, or products included on Hustl. You expressly agree that your use of our Service is at your sole risk. To the fullest extent permissible by applicable law, Morehustl Limited disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
